BROOKS INTEGRATED MARKETING PRIVACY POLICY

Brooks Integrated Marketing (BrooksIM), a direct and targeted marketing company that provides marketing services to local, regional, national and international consumer and business-to-business marketers. This Privacy Policy describes how BrooksIM uses personally identifiable information (“Personal Information”) about our customers collected on the BrooksIM websites operated around the world. By using one of our websites or providing any Personal Information using one of our sites, you are agreeing to the collection and use of Personal Information in the manner described in this Privacy Policy.
 
PERSONAL INFORMATION WE COLLECT

We may collect personal information about you in different ways, including as follows:
 
  • Account Registration, such as your first and last name, email address, telephone number, or other contact information that you provide to us.
  • Device and Internet Browsing Information, including information automatically collected about your browsing activity, IP address, unique device identifiers, cookie identifiers, device and browser settings and information, and Internet service provider information. We may also collect information about when and how you access and use our website, such as the date and time of your visit or use, how you navigate and what you search for on our website, the pages visited, the types of content you interact with, and the frequency and durations of your activities.
  • Data Uploaded to BrooksIM, which is used to generate match reports or updated records including updated addresses for records that moved or been appended with new information. The data will be destroyed when no longer needed for operational and legal purposes and not used for any other purpose than directed by the client.
  • Other Personal Information that you may voluntarily choose to provide to us, such as your location.

HOW WE USE PERSONAL INFORMATION

We use personal information for a variety of business and commercial purposes, including to conduct our business, and for purposes that may be disclosed to you at the time you provide your personal information. We know transparency is important so below is more information of how we may use your personal information: 
 
  • Improve our services.
  • Administer, operate and manage our business.
  • Conduct analytics.
  • Connect with you (e.g., addressing your requests, inquiries, issues, or feedback). 
  • Enforce our policies and agreements.
  • Comply with legal or regulatory obligations.

The sections above describe our main purposes in collecting your personal information, but often we have multiple purposes.

HOW WE DISCLOSE PERSONAL INFORMATION

In addition to the specific situations discussed elsewhere in this Privacy Notice we may disclose any of the personal information we collect to the third parties described below, in the following situations: 
 
  • With Law Enforcement or As Needed for Litigation. We may share personal information to cooperate with law enforcement, participate in a legal process, or for legal compliance. We may share your personal information to establish or exercise our rights, to defend against legal claims, to investigate, prevent, or act on possible illegal activities, threats to safety of person or property, or a violation of our policies. 
  • Service Providers. We may share your personal information with service providers, who may help us to run our website, provide technical support, and/or assist with our provision of services.
  • Professional Services. We may share personal information with our professional service providers, such as auditors or lawyers.
  • Other Disclosures as Required by law. We may share your personal information with law enforcement, regulators or other third parties as required by law.
  • Acquisitions.  We may share your personal information with a third party that acquires or enters our company, business, or assets or in the event of a due diligence exercise carried out by a potential investor, partner or purchaser (in which event disclosure shall be to the potential investor, partner or purchaser and its professional advisers, and shall be limited to the extent required and subject to confidentiality protections to the extent practicable). 
  • Other Third Parties. We may use your non-sensitive personal information, such as device or usage data, to generate analytics and may share or sell this information to trusted third parties for research, marketing, or service improvement purposes.

COOKIES AND INFORMATION AUTOMATICALLY TRACKED.

Our server software gathers in log files, general demographic information from all users of our websites. This includes browser types, IP addresses and referring domains. We use this information to help us understand our visitors’ needs.

If you choose to receive information regarding BrooksIM’ products and/or services, you may be required to complete an information request form. This form may require your name, company name, e-mail address, company address, phone number as well as other information to help us determine and respond to your needs related to the products and/or services requested. We use this Personal Information to send updates about our company and our products and to contact you if requested or necessary. We also use the demographic information you provide on these forms in connection with studies and reports regarding our websites, such as website usage patterns, in order to better understand the needs of visitors to our websites. We will not, however, associate any Personal Information which you provide with the information in these studies and reports.

Your customer contact information collected from these contests and promotions may be used to contact you when necessary. In addition, if you elect to provide us information regarding others you believe may be interested in receiving information about our products or services, such as in our ‘refer a friend’ program, we will use the information you supply to contact these persons. Any mailings we provide to these persons will contain a method for them to opt out of receiving future mailings.

SECURITY AND DISCLOSURE.

No method of internet transmission or electronic storage is fully secure. While we use reasonable efforts to protect personal information, we cannot guarantee its security. If we are required to inform you about a security incident, we will do so electronically, in writing, or by phone, as the law permits.

We use security measures to protect against the loss, misuse, and alteration of the information under our control which is gathered from our websites. We store this information in a secure environment at one or more of our service providers. BrooksIM personnel with access to this information have been advised of the importance of maintaining the confidentiality of such information and of using it only for the purposes described in this Privacy Policy.

To facilitate mailings to our customers, BrooksIM may provide the necessary mailing information to bonded third party contractors which will perform the mailing on our behalf.
BrooksIM is not responsible for the privacy practices or the content of any other websites to which we link.

HOW WE RETAIN PERSONAL INFORMATION

We keep your personal information for only as long as necessary to fulfil the purposes in this Privacy Notice unless a longer retention period is required or permitted by law. This includes the purposes of satisfying legal, accounting, or reporting requirements. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information. We also weigh the potential risk of harm from unauthorized use or disclosure of the personal information, the purposes for which we obtained the personal information and whether we can meet those purposes through other means, as well as applicable legal requirements.

You may correct inaccurate or incomplete data by logging into your account and revising the data. We may keep historical data in our backup files as permitted by law.

From January 1 to December 31, 2023, we received a total of 145 requests. In 2024, that number increased dramatically to 68,593, all of which we have fulfilled. While our average response time was previously over 10 days, we implemented new processes reducing our typical response time to approximately 1 business day.

3) Call our corporate office at 1-800-531-2601x998 and request to opt out
If you receive marketing or similar e-mail messages from us and wish to opt out of receiving such messages, then you may simply follow the opt-out procedure specified in such e-mail. In addition, if you have registered on one of our sites, you may log onto such site and, using your password, update your personal profile to opt out of receiving any future marketing or similar messages. You may, of course, use this same process to access your personal profile and update other aspects of your Personal Information.
Not all the rights above are absolute, and they do not apply in all circumstances. We may limit or deny a  request because the law permits or requires us to.

NOTIFICATION OF PRIVACY POLICY CHANGES.

BrooksIM may amend this Privacy Policy from time to time. If BrooksIM decides to make substantial changes in the way we use your Personal Information, we will post the changes on this page so that you always will know what information we collect, how it is used, and when and how it will be disclosed. Your use of any BrooksIM website following notice of such change will be deemed acceptance of the revised Privacy Policy, which may include application of the new policy to information provided prior to the date of such change.
